IMPORTANT: Please read these Terms carefully before using Safe Backup. By using our Service, you agree to be bound by these Terms, including the limitations of liability and disclaimers contained herein.

1. Acceptance of Terms

By accessing or using Safe Backup ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. Your continued use of the Service constitutes acceptance of any modifications to these Terms.

2. Description of Service

Safe Backup provides automated backup services for Airtable databases. Our Service allows you to:

  • Create automated backups of your Airtable bases
  • Store backups in your preferred cloud storage
  • Download and restore data from backups
  • Manage backup schedules and retention policies

Important: Safe Backup is a backup tool and does not guarantee data recovery in all circumstances. The Service is provided "as is" and we recommend maintaining multiple backup strategies for critical data.

3. User Accounts

To use certain features of the Service, you must create an account. You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and current
  • Securing your connected third-party accounts (Airtable, cloud storage)

We are not liable for any loss or damage arising from your failure to comply with these security obligations.

4. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy. You retain ownership of your data at all times.

5. Your Responsibilities

You are responsible for:

  • Ensuring you have the right to backup the data you submit to our Service
  • Verifying that your backups are completing successfully
  • Maintaining your own independent backup strategy for critical data
  • Testing restore procedures before relying on them in emergencies
  • Complying with all applicable laws regarding your data
  • Ensuring your use of the Service does not violate any third-party rights

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit malicious code or interfere with the Service
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any illegal or unauthorized purpose
  • Backup data you do not have the right to copy or store
  • Circumvent any usage limits or restrictions

7. Subscription and Billing

Some features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

  • Prices are subject to change with 30 days notice
  • Refunds are provided at our sole discretion
  • Failure to pay may result in service suspension
  • You are responsible for all applicable taxes

8. Service Availability and No Guarantee

We strive to maintain reliable service availability. However:

  • We do not guarantee uninterrupted or error-free service
  • We may temporarily suspend the Service for maintenance, updates, or other operational reasons
  • We do not guarantee that backups will always complete successfully
  • We do not guarantee that all data can be recovered from backups
  • Third-party service outages (Airtable, cloud storage providers) may affect our Service

You acknowledge that no backup system is infallible and you should not rely solely on Safe Backup for critical data protection.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Safe Backup and are protected by international copyright, trademark, and other intellectual property laws. You retain full ownership of your data and content.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Safe Backup, its subsidiaries, affiliates, and licensors do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements
  • Your data will be successfully backed up or recoverable
  • Backups will be complete, accurate, or uncorrupted

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAFE BACKUP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, or business
  • Loss of data or data corruption
  • Loss of goodwill or reputation
  • Cost of procurement of substitute services
  • Any other intangible losses

This limitation applies whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, whether or not we have been informed of the possibility of such damage.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO SAFE BACKUP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.

12. Specific Data Loss Disclaimer

You expressly acknowledge and agree that:

  • Safe Backup is not responsible for any data loss, regardless of cause
  • Backups may fail due to technical issues, API limitations, or third-party service problems
  • Restored data may differ from original data due to format conversions or limitations
  • You are solely responsible for verifying backup integrity
  • You should maintain independent backups of critical data
  • We are not liable for any business interruption caused by data loss or backup failures

13. Indemnification

You agree to defend, indemnify, and hold harmless Safe Backup and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; (d) any claim that your data caused damage to a third party; or (e) your violation of any applicable law or regulation.

14. Third-Party Services

The Service integrates with third-party services including Airtable, Google Drive, Microsoft OneDrive, Dropbox, and Amazon S3. You acknowledge that:

  • We are not responsible for the availability or performance of third-party services
  • Your use of third-party services is subject to their respective terms and policies
  • Changes to third-party APIs may affect our Service functionality
  • We are not liable for any issues arising from third-party service failures

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Conduct harmful to other users, us, or third parties
  • Non-payment of fees
  • At our sole discretion for any other reason

Upon termination, your right to use the Service will immediately cease. You are responsible for exporting your data before termination. We are not obligated to retain your data after account termination.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you by email. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Safe Backup concerning the Service and supersede all prior agreements and understandings.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Paris, France. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

20. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Safe Backup.
